1. Introduction

Hard Money Lenders of Phoenix (the “Site”) is a lead-generation service operated by Lead Skills, LLC (“we,” “us,” “our”). We are not a lender. We connect borrowers who submit inquiries with one or more participating hard money lenders who may be able to provide financing.

Because we collect financial information to facilitate these introductions, our activities are subject to the federal Gramm-Leach-Bliley Act (GLBA) and its implementing Privacy Rule and Safeguards Rule. This Privacy Policy describes the categories of information we collect, how we use and share it, and the choices you have about our use of your information.

2. Information We Collect

We collect the following categories of information when you use the Site or submit an inquiry:

• Identifiers: name, postal address, email address, telephone number, and similar contact information.
• Property and investment information: property address, property type, estimated value, purchase price, rehab budget, project timeline, exit strategy, and similar details about the transaction you are inquiring about.
• Financial information: information about your investing experience, funding needs, credit profile, income, and other financial details relevant to matching you with a participating lender.
• Usage and device data: IP address, browser type, device identifiers, pages viewed, referring URL, and similar information collected automatically when you visit the Site.
• Communication records: records and content of calls, emails, text messages, and form submissions you exchange with us or with participating lenders we introduce you to.

3. How We Use Your Information

We use the information we collect to:

• Match you with one or more participating lenders who may be able to provide financing;
• Respond to your questions and communicate with you about your inquiry;
• Operate, maintain, secure, and improve the Site and our services;
• Prevent fraud, abuse, and other unauthorized activity; and
• Comply with legal obligations and enforce our Terms of Service.

4. How We Share Your Information (GLBA Disclosure)

We share your information in the following categories:

• Participating lenders. When you submit an inquiry, we share the information you provide with one or more participating hard money lenders so they can evaluate whether they may be able to provide financing and contact you about your inquiry. A current list of participating lenders is available upon request.
• Service providers. We share information with vendors that perform services on our behalf, such as hosting, email delivery, SMS delivery, analytics, spam and abuse prevention, and customer support. These service providers are permitted to use your information only to perform services for us.
• Legal, safety, and compliance. We may disclose information to comply with subpoenas, court orders, regulatory requests, and other legal obligations, and to protect the rights, property, or safety of Lead Skills, LLC, our users, participating lenders, or others.
• Business transfers. If we are involved in a merger, acquisition, reorganization, financing, sale of assets, or similar transaction, your information may be transferred as part of that transaction.

We do not sell your personal information.

5. Your Right to Limit Sharing

By submitting an inquiry through this Site, you authorize us to share your information with participating lenders so they can evaluate and respond to your inquiry. If you do not want your information shared with participating lenders, please do not submit an inquiry. You may also contact us at [email protected] to request that we stop sharing your information with additional lenders going forward. Participating lenders you have already been matched with will have their own privacy practices and retention policies that govern information already shared with them.

6. Data Security

Consistent with the GLBA Safeguards Rule, we maintain administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of the information we collect. These safeguards include access controls, encryption in transit, logging, vendor risk review, and employee training. No system can be guaranteed 100% secure, but we continuously work to identify and address new risks.

7. Your Choices

• Access, correction, deletion. You may request access to, correction of, or deletion of personal information we maintain about you by contacting us using the information in Section 10. Some information may be retained as required by law or to complete transactions you initiated.
• SMS / text messages. You may opt out of marketing text messages at any time by replying STOP to any text message you receive from us or a participating lender. You may receive a final confirmation message.
• Phone calls. You may ask us or a participating lender to stop calling you at any time during a call or by contacting us.
• Email. You may unsubscribe from marketing emails using the unsubscribe link in the email or by contacting us.

8. Children's Privacy

The Site is not directed to children under 18, and we do not knowingly collect personal information from children under 18. If we learn that we have collected information from a child under 18, we will delete it.

9. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the “Last Updated” date above and, where appropriate, provide additional notice. Your continued use of the Site after an update means you accept the updated Policy.
