Terms of Service

1. Introduction and Agreement

These Terms of Service (“Terms”) govern your access to and use of hardmoneylendersofphoenix.com (the “Site”), which is operated by Lead Skills, LLC (“we,” “us,” “our”). By accessing or using the Site, submitting an inquiry, or otherwise interacting with our services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

The Site is a lead-generation service that connects prospective borrowers with one or more participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including loan approval, rates, terms, fees, and funding timelines, are made solely by the participating lender.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer, solicitation, or commitment to lend, to arrange credit, or to engage in any regulated financial activity. Submitting an inquiry does not create a borrower-lender relationship between you and us, and does not guarantee that you will be matched with a lender or receive a loan offer. All loan programs are subject to borrower and property qualification by the participating lender, and rates, terms, and conditions vary by lender and are subject to change without notice.

4. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract to use the Site. You agree that all information you provide through the Site is true, accurate, current, and complete, and that you will promptly update any information that changes.

5. Your Consent to Be Contacted

By submitting an inquiry and checking the consent box on our contact form, you provide your prior express written consent for us and one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text or by calling (602) 755-6963. A current list of participating lenders is available upon request.

6. Equal Opportunity

We connect borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age (provided the borrower has the capacity to contract).

7. Acceptable Use

You agree not to:

• Use the Site for any unlawful, fraudulent, or deceptive purpose;
• Submit false, misleading, or third-party information without authorization;
• Attempt to gain unauthorized access to the Site or its underlying systems;
• Interfere with or disrupt the operation of the Site, including by introducing malware; or
• Use automated means to scrape, crawl, or copy content from the Site.

8. Intellectual Property

The Site, including its design, text, graphics, logos, and underlying code, is owned by Lead Skills, LLC or its licensors and is protected by United States and international intellectual property laws. You may view the Site for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

9. Third-Party Links and Services

The Site may contain links to, or be presented alongside, third-party websites and services (including those of participating lenders). We do not control, endorse, or assume responsibility for the content, privacy practices, or conduct of third parties. Your interactions with participating lenders and other third parties are solely between you and that third party.

10. Disclaimers

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION OBTAINED THROUGH THE SITE WILL BE ACCURATE, CURRENT, OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE CONDUCT OF ANY PARTICIPATING LENDER, WHETHER BASED IN CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Lead Skills, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party right.

13. Governing Law

These Terms are governed by the laws of the State of Arizona without regard to its conflict-of-law principles. You and we agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona, for any dispute arising out of or relating to these Terms or the Site.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date above and, where appropriate, provide additional notice. Your continued use of the Site after an update means you accept the updated Terms.
